Forhandlingsprinsippet er innenfor sivilprosessen den grunnsetning at dommeren skal forholde seg passiv når det gjelder å skaffe til veie bevismidlene i saken. Partene har selv ansvaret for at det blir lagt frem fullstendige opplysninger.
Forhandlingsprinsippet legger til grunn at det er partene som har ansvar for å innhente dokumenter og legge fram bevis.
