Each joint tenant has an equal, undivided right in the property - no joint tenant's share can be larger or smaller than any other joint tenant's share.
In a tenancy in common, each tenant in common has individual ownership right in the property, that he or she may sell without the permission of the other tenant or tenants in common. Tenants in common may hold shares in various sizes.

Dále je v platné právní úpravě občanského zákoníku obsažena úprava společného jmění, která vychází z původního rozlišení spoluvlastnictví na podílové a bezpodílové. Rozdíl mezi oběma druhy spoluvlastnictví spočívá ve vyjádření podílů. Podíly jsou určeny pouze u podílového spoluvlastnictví, kdežto u bezpodílového spoluvlastnictví nepřichází pojmově vyjádření podílů v úvahu; každému z bezpodílových spoluvlastníků přísluší vlastnické právo k celé věci, přičemž toto vlastnické právo je současně omezeno vlastnickým právem druhého bezpodílového spoluvlastníka k téže věci. Bezpodílové spoluvlastnictví mohlo v ČR vzniknout jen mezi manžely; mezi jinými subjekty vždy vznikalo jen spoluvlastnictví podílové (také manželé mohli a mohou být podílovými spoluvlastníky).Bezpodílové spoluvlastnictví upravoval ObčZ jako základní spoluvlastnický vztah mezi manžely, od 1. 8. 1998 bylo bezpodílové spoluvlastnictví manželů nahrazeno společným jměním manželů (§143 , §151 ObčZ ).

(2) Společné jmění může vzniknout jen mezi manžely.
