The campaign was a testament to XXXX’s evident care-free, lighthearted attitude towards consumer and corporate culture. It seems XXXX was testing the limits of trademark law using transgression to make a larger statement. During the campaign, XXXX sent this message to the companies it targeted:

“You spend your days playing legal ***whack-a-mole*** with harmless and inevitable brand infringement. We’ve made a different game for you! Your C&Ds are used to shut down independent creativity, but now you have the opportunity to use one to participate in an actual creative endeavor. Get writing!”


whack-a-mole è un gioco... vogliono dire che non appena le aziende vincono un'azione legale di diffida (il "cease and desist") devono subito fare i conti con un altro tentativo di contraffazione (credo che la traduzione letterale del gioco non renderebbe l'idea)

Penso che la traduzione letterale potrebbe essere comunque una buona soluzione, anche se meno trasparente dell’inglese:

giocando ad un continuo/ripetuto “acchiappa la talpa” legale…

Il lettore che conosce il gioco capirebbe subito l’immagine e l’idea trasmessa. E con l’aggiunta di “continuo” o “ripetuto” anche chi non conosce il gioco potrà farsi l’idea di un’azione che si ripete sempre.

Explanation:
espressione poco comune (in rete trovo solo due riscontri - o meglio uno, è lo stesso ripetuto) ma che secondo me rende l'idea: i buchi da tappare sono tanti e piccoli, e si perde solo tempo (torna anche con "harmless and inevitable")
