A enquadrar no contexto, pois a minha sugestão significa que uma entidade assume a dívida de outra entidade/pessoa.

Na minha sugestão, "assunção" não designa "reconhecimento", portanto, é o oposto das palavras que antecedem imediatamente o texto colocado pela colega, ou seja "confissão de dívida".

partial novation

Looks like a novation vs. assignment to me unsure whether the word 'of debt' is really necessary, namely a novation agreement substitutes an incoming debtor for an outgoing debtor whilst the original creditor remains the same: L.B. Curzon, Dictionary of English Law.

Might be a questionable fragmentation in Anglo-Am. law but other may care to take the baton and run with it: 'Until the courts give clear guidance on whether a novation of part is possible, avoid a “partial” novation, unless it is essential. '




Example sentence:

The novation is a way to transfer debt to a wholly unique party, who will then step in and take the place of the original party in the contract. Such change requires consent of both parties, including the party that is benefiting from the change.

Whilst the difference between assignment + novation is relatively small, it is an essential one. Assigning when you should novate could leave you ... liable for your original contract when the other party is not liable to perform his obligations.

That's lazy, *professionally negligent* nonsense. The legal one, as you now know, is a substitution of debtor: 'Novation is a way to transfer *debt* to a wholly unique party, who will then step in + take the place of the original party in the contract,'
