din Black's Law Dictionary Institution - A system or body of laws or regulations, of extensive and recurring operation. Its object is to generate, effect, regulate or sanction a succession of acts, transactions .... We are likewise in the habit of calling single laws or usages „institutions” ....

Nu cred că există așa ceva ca „institution of offence” (sau n-am auzit eu de așa ceva)

în vorbirea juridică „instituție”(instituție de drept) înseamnă „principiu/set de reguli”. Deci - conceptul de infracțiune este un principiu/set de reguli fundamental al dr. penal.
