German term

Auflösung des Vereins und **Anfallberechtigung**

German to English Law/Patents Law: Contract(s) charter of an association
This is one of the articles in a charter for an association. In this part, it describes the actions to be taken when the association is terminated & I am unsure of how to translate **Anfallberechtigung**. I'm sure it has something to do with leftover assets, but can't seem to find any official translation anywhere...

Here's the paragraph that follows this paragraph (for context):

UK English is preferred in this case!

Thanks!

Sorry to be so confusing in my wording, I'm up pretty late.
Thanks for the link to the other discussion - I think that solved the problem!
philgoddard Feb 7, 2013:
And what does the paragraph after that say? I can't see anything about an Anfallsberechtigung in the paragraph you've given us.
We've had this before by the way, though I think the context may be different:

Jocelyn Polen (asker) Feb 7, 2013:
Whoops - yes, that's what I meant: "Auflösung des Vereins und Anfallberechtigung" is the title of that paragraph (followed by the contents of the paragraph).
philgoddard Feb 7, 2013:
You say 'the paragraph that follows this paragraph.' Do you mean 'the paragraph that follows this title'? If not, could you give us the paragraph containing the phrase? Thanks.

dissolution of the association/club/society and disposal of assets (upon dissolution)

I had to check what the English version of our e.V.'s Satzung says here.

Typical phrasing associated with dissolution of a non-profit association are "distribution/disposal of assets/rights upon dissolution".

D.h., also "dissolution of the association and entitlement as a contingent beneficiary"

disagree pj-ffm : This has nothing to do with wills or insurance. FYI: a "contingent beneficiary" is someone who will receive the benefits if the primary beneficiary has died at the time the benefit is to be paid. Also, try Googling your suggestion (with quotes) cf. mine.

(dissolution of the association and) beneficial entitlement to the surplus assets

Look at the dissolution of *unincorporated* assocs. in the EN law of Equity.

Erkehan's contingent beneficiary IMO right for the Anfall(s)berechtigter.
Example sentence:

The onus of proof was on the person seeking to show that the beneficial ownership .... unincorporated association and its assets were owned by the members of the ... In Walton J's view the surplus assets of the association, being ownerless
