Should Customer’s use of the Product be determined to have infringed any third party rights, or if in CC’s judgment, such use is likely to be infringing, CC shall endeavor at its option do one of the following, at its own expense: procure for Customer the right to continue owning or using the Product, as applicable, replace or modify the Product to make its Use non-infringing while yielding substantially equivalent functionality.
