Source text - English Agreement made in the city of New York, this 10th day of August, 2003, by and between XYZ, and ABC S.A., in relation to the following reference:
1. SCOPE OF SERVICES:
XYZ shall provide ABC SA with technical advice and technological assistance and assessment in order to enable the latter to construct a new premise and modernize the existing plant in Florida.
2. TERM
This contract shall become effective as from the date of registration with the application authority and remain in force until the time at which technical assistance shall have been fully provided.
3. REMUNERATION AND TERMS OF PAYMENT
In consideration of the technical advice and technological assessment to be rendered, ABC SA shall pay XYZ a total amount of U.S. DOLLARS 1,000,000.00. Payment shall be made within 180 working days as from the date of registration hereof with the application authority hereinbefore mentioned.
4. CONFIDENTIALITY CLAUSE
ABC SA hereby agrees that it will not disclose XYZ's method and procedure to any third parties other than ABC SA during the term of this agreement and for a further year.
5. FORCE MAJEURE
In no case shall failure or omission by either party to carry out any of the terms or conditions stated herein give rise to any claim against the party in question or be deemed a breach of this agreement if such failure or omission arises from any cause reasonably beyond the control of that party.
6. INDEPENDENT CONTRACTOR STATUS:
XYZ being an independent contractor, it shall be full and solely responsible for its personnel for all legal duties.
7. GOVERNING LAW AND JURISDICTION:
It is hereby agreed that if any dispute arises hereunder, the NY Legislation shall apply for construction purposes.
8. NOTICES
Any and all notices required hereunder shall be given in writing and addressed to the party entitled to notice at his address set forth in this agreement.
9. ASSIGNMENT
Neither party shall assign their rights and duties foreseen under this Agreement without the prior written consent of the other party.

6.CONDICIONES DEL CONTRATISTA INDEPENDIENTE:
Dado que XYZ ostenta la condición de contratista independiente, éste se hace pleno responsable de su personal en lo que a obligaciones jurídicas se refiere.
7.LEGISLACIÓN APLICABLE Y COMPETENCIA:

Source text - English Advertising professionals realize that the heart of any campaign is the product and the position it holds in people's minds. Products and their brand names are newsmakers themselves. Wendy's hamburgers, and California raisins (particularly when they sing and dance) are objects of our attention and interest .
Understanding the complexities of a brand identity and its position is no easy task. A good case in point is the activities of Coca-Cola in the last few years. After a $4 million research project, Coca-Cola brought out a new Coke formula in May 1985 with the intention of retiring the old formula. To everyone's surprise, the intense feelings of American consumers toward old Coke were such that the old formula had to be kept on the market, renamed Coke Classic.
When they first appeared, generics were seen as threats to brand products, particularly for products for which lower price might be a primary criterion for purchase. Although generics enjoyed growth during the recession of the early 1980s, they have now dropped back to their selling level at introduction. In their growth stage, however, the threat they posed to brands stimulated major manufacturers to bring out lower-cost brands that were more competitive with the generics.
One of the most controversial areas of product concepts is the brand extension. A new product gets to share the name of an older, established brand. Today brand extensions occur not only within the company, but companies are licensing their brandnames to all kinds of products in the hope of increasing brand awareness. Department stores have whole sections devoted to Coca-Cola clothing.
Market segmentation is the selection of groups of people who will be most receptive to a product. The most frequent methods of segmenting include demographic variables such as age, sex, race, income, occupation, education, household status, and geographic location; psychographic variables such as life-style, activities, interests, and opinions; product use patterns; and product benefits. Much segmentation involves combinations of these methods.
In a related article, "Losing Something in the Translation," we find a marketing situation in which Hispanics were treated as a homogeneous segment. The article asks whether selling Pepsi as a low-caffeine drink will be effective for Hispanics, who here are characterized as less interested in nutritional arguments than are other segments of the U.S. population. Here again the question arises as to whether campaigns can be simply translated to any segment or any nationality in a global marketing strategy, or whether strategies must be specifically designed for particular cultural groups. If it is true that Hispanics are becoming more diverse as their incomes increase, then we might expect the Pepsi campaign to work quite well.
In demographic segmentation the affluent are defined as those with annual incomes of $75,000 or more. Although there are only 3.3 million such households in the United States, their buying power makes them obviously important to many product categories. As can be seen, although these individuals are alike in income, they are quite different in other terms. They are at different stages of life, they have different attitudes toward materialism, and they shop at a variety of retail outlets.

La segmentación de mercado consiste en seleccionar qué grupos de personas serán las más receptivas a un producto. Los métodos más frecuentes de segmentación incluyen: variables demográficas como edad, género, raza, ingresos, profesión, nivel educativo, condición de la vivienda y ubicación geográfica; variables psicográficas como estilo de vida, pasatiempos, intereses y opiniones ; los patrones de uso del producto y los beneficios del producto. Mucha segmentación implica la combinación de estos métodos.
En un artículo afín, “Perder parte de la traducción” (Losing Something in Translation), encontramos una situación de mercadotecnia en la que la población hispana fue tratada como un segmento homogéneo. El artículo cuestiona si vender Pepsi como una bebida baja en cafeína, será eficaz entre la población hispana, caracterizada por estar menos interesada en cuestiones de nutrición que otros segmentos de la población de EE.UU. Aquí, una vez más, se plantea el debate de si las campañas publicitarias pueden simplemente dirigirse a cualquier segmento o nacionalidad en una estrategia de mercado global o si bien, las estrategias deben ser específicamente diseñadas para grupos culturales determinados.
