English to Russian: The UK Immigration Bill General field: Law/Patents Detailed field: Law (general)
Source text - English The Immigration Bill has been a key feature of the political debate in the UK over the past few months. The Bill received Royal Assent on 14 May 2014 so we’ve taken a look at the major changes and how they’re likely to affect you.
Restricting the ‘Right-of-Appeal’
The bill will cut the current extended rights of appeal for immigration cases down to only three:
• Decisions to refuse a claim of asylum or humanitarian protection
• Decisions to refuse a human rights claim
• Decision to revoke asylum or humanitarian protection
This is very concerning, given the Home Office’s history of poor decision-making.
Landlord Immigration Checks
The Liberal Democrats fierce opposition and lobbying from charities and other groups has ensured a watered down version of the landlord immigration checks. Basically, the government wants to turn landlords into border security staff, but it’s not all bad news.
National Roll-out of Landlord Immigration Checks will not take immediate effect
The landlord immigration checks have not been set for a national roll-out at this stage. Instead, they’re going to run a test in an area of the UK before deciding how a national roll-out of landlord immigration checks should work. There’s no word yet where the pilot area for the landlord immigration checks will be. There’s a chance that the national roll-out of the landlord immigration checks might not happen if we see a change of government during the next general election on 7 May 2015.
Exemptions from Landlord Immigration Checks
After successful lobbying, the following groups are exempt from landlord immigration checks:
• Students
• Homeless hostels
• Refuges for women, and
• Accommodation for vulnerable people in immediate need
Access to Healthcare: New Charging Framework for Migrants
The Department of Health has been given the go ahead to develop a new charging regime for migrants. Exactly what this will entail hasn’t been decided but it is very likely that migrants will now have to pay for some services. We’ve been given some clues that hint that access to basic healthcare shouldn’t be too badly affected because Government spokesman, Lord Taylor of Holbeach has said
• GP and nurse consultations should remain free
• They want to strengthen the current NHS charging regulations for vulnerable groups.
Ability to Strip Naturalised British Citizens of their Citizenship
This clause in the Immigration Bill will give the Government the ability to strip naturalised British citizens of their citizenship if they deem a persons actions to be ‘seriously prejudicial to the vital interests of the UK’. This precedent was set during the landmark case: The Supreme Court ruling in Secretary of State for the Home Department v Al Jedda [2013] UKSC 62.
Amendments to the Clause to Protect against ‘Statelessness’
To try and alleviate concerns that naturalised British citizens who have their citizenship revoked could become ‘stateless’ (i.e. belong to no country), two amendments have been made.
1. The Home Secretary can only use this power if there are ‘reasonable grounds’ to believe an individual can become a citizen elsewhere
2. An independent review of the power in practice after one year
This is an important amendment because individuals who are stateless would be unable to leave British soil.

Урезание прав на апелляцию
В рамках данного законопроекта предусматривается, что обжаловать иммиграционные решения будет возможно лишь в трех случаях:

по решениям об аннулировании убежища или гуманитарной защиты.
На фоне далеко не безупречной статистики принимаемых МВД Великобритании (Home Office) решений это выглядит несколько тревожно.

Доступ к медицинскому обслуживанию: новая схема оплаты медицинских услуг мигрантами
Министерство здравоохранения получило добро на внедрение новой схемы по оплате услуг мигрантами. В чем именно это будет выражаться пока не совсем ясно, однако весьма вероятно, что отныне мигрантам придется платить за определенные медицинские услуги. Из неофициальных источников мы узнали, что это не скажется серьезным образом на оказании базовой медицинской помощи, как утверждает представитель правительства лорд Тейлор.
Консультации врачей общей практики и медсестер должны остаться бесплатными.
Целью при этом является укрепить нынешнюю систему оплаты услуг NHS для слабозащищенных групп.
Возможность лишать британского гражданства тех, кто его получил в результате процесса натурализации
Этот пункт иммиграционного законопроекта предусматривает возможность лишать гражданства тех, кто получил его в результате натурализации, если будет признано, что их действия "наносят серьезный вред жизненно важным интересам Великобритании". Прецедент был создан в результате решения Верховного суда Англии и Уэльса по делу Министр внутренних дел Великобритании против Аль Джедда [2013] UKSC 62.
Поправки с целью защитить оказавшихся без гражданства лиц
В целях отреагировать на прозвучавшие опасения о том, что натурализовавшиеся граждане, которые будут лишены британского гражданства, могут вообще оказаться без гражданства (т.е без принадлежности к какой-либо стране), были внесены две поправки.

A native Russian speaker I moved to the UK from Belarus in 2000. I hold a BA in English and French from the Minsk State Linguistic University and a MA in Translation from the University of Westminster, UK.
I began building my freelance network by providing pro bono translations in a human rights field and over the years I translated hundreds of thousands of words both on pro bono and commercial basis. At the same time, I expanded my experience in the UK corporate sector and worked as an in-house translator in shipping and blue-chip financial institutions until 2009 when I joined a translation team in a leading immigration and human rights law practice in London. I worked there for over 5 years before going freelance at the end of 2014.
In 2011 I passed the exam to become a Qualified Member of the Institute of Translation and Interpreting (MITI) with specialisation in the area of law.
In June 2015 I moved to Sydney, Australia. Here I joined the Australian Institute of Interpreters and Translators (AUSIT). In 2016 I was accredited by the National Accreditation Authority for Translators and Interpreters (NAATI) as a professional translator from English to Russian.
My main area of specialisation is legal translation. I understand the pressures of this sector and the need to produce high quality work within extremely tight deadlines. I pride myself in delivering reliable translations meeting the expectations of the most demanding clients. The types of documents I work with vary from counsel arguments, particulars of claim, witness statements to powers of attorney and client engagement letters.
My current time zone in Australia allows me to complete urgent translations for my clients based in Europe overnight.
As a result of working closely with lawyers over a number of years I have developed a keen interest in law and the human rights field. So after relocating to Australia in 2015, in order to enhance my knowledge and understanding of the subject matter and all its intricacies, I enrolled on an LLB course with the University of London International Programmes, of which I have now successfully completed four units.
As a qualified member of the Institute of Translation and Interpreting I fully uphold its Code of Professional Conduct for translators and interpreters and only take on projects that are within my areas of expertise and skills.
I have also recently become ISO 17100:2015 Qualified.
