Source text - English The case originated in an application (no. 35214/09) against the Kingdom of Spain lodged with the Court under Article 34 of the Convention for the Protection of Human Rights and Fundamental Freedoms (“the Convention”) by a Spanish national, Mr Antonio Aldeguer Tomás (“the applicant”), on 22 June 2009.

The applicant complained under Article 14 of the Convention taken in conjunction with Article 8 that he had been discriminated against on the ground of his sexual orientation in that he had been denied a survivor’s pension following the death of his partner, with whom he had lived in a de facto marital relationship for twelve years. In substance the applicant also relied on Article 14 of the Convention in conjunction with Article 1 of Protocol No. 1 to the Convention.
THE FACTS
I. THE CIRCUMSTANCES OF THE CASE
7. The applicant cohabited with another man in a homosexual relationship from 1990 until the latter’s death on 2 July 2002. During that period they lived together in an apartment belonging to the applicant’s partner. When his partner died, the sister and only heir of the applicant’s partner gave the applicant, because of the relationship he had had with her brother, an apartment that had belonged to the applicant’s late partner and in which the couple had spent their holidays together since 1990.
8. On 19 September 2003 the applicant claimed social security allowances as a surviving spouse , under section 174 (1) of the General Social Security Act , arguing that he had cohabited with his deceased partner for many years.
9. On 22 September 2003 the National Institute of Social Security (Instituto Nacional de la Seguridad Social, hereafter referred to as “INSS”) refused to grant the applicant a survivor’s pension on the ground that since he had not been married to the deceasedhe could not legally be considered as his surviving spouse for the purposes of section 174 (1) of the General Social Security Act. That decision was formally served on 13 June 2005.
10. On 1 July 2005 Law no. 13/2005 amending the provisions of the Civil Code with respect to the right to enter into marriage was passed. Two days later it entered into force. This law legalised same-sex marriage in Spain. In accordance with its first additional provision all legal and regulatory provisions making reference to marriage should be understood thereafter as applicable to all marriages irrespective of the sex of its members (see paragraph 35 below).
11. On 5 July 2005 the applicant filed an administrative complaint against the decision of 22 September 2003. This complaint was dismissed by the INSS on 11 August 2005. The INSS noted that there was no provision in the legislation in force that allowed, for the purposes of social security rights, the person who had been cohabiting with the deceased to gain the status of a widower.
12. On 26 September 2005 the applicant challenged that decision before the Madrid Social Tribunal no. 33 (“the Social Tribunal”).
13. In a judgment of 14 November 2005 the Social Tribunal ruled for the applicant. The Social Tribunal firstly outlined that the facts of the case had to be assessed in the light of the newly enacted Law no. 13/2005, which was already in force and deemed constitutional by the tribunal. As to the merits, the Social Tribunal observed that the issue at stake was whether the applicant, as the surviving partner of a same-sex relationship that ended (following his partner’s death) before the entry into force of Law no. 13/2005, had the right to a survivor’s pension. The Social Tribunal then reiterated that, according to the well-established domestic vis-à-vis , surviving partners of unmarried couples were not entitled to a survivor’s pension under section 174 of the General Social Security Act, marriage being a constitutive element to access any such social-security benefit; that the applicant had been prevented from marrying his partner because same-sex marriage had not been recognised in domestic law at the time his partner died; that the social security administration had relied on the fact that the couple had not married to refuse the applicant a survivor’s pension; and that it was evident that after the entry into force of Law no. 13/2005, surviving spouses of same-sex marriages were entitled to survivors’ pensions on the same footing as survivors of different-sex marriages.

El asunto trae causa de la solicitud (Núm. 35214/09) interpuesta ante el Tribunal Europeo de los Derechos Humanos contra el Reino de España en virtud del artículo 34 del Convenio para la Protección de los Derechos Humanos y las Libertades Individuales (en adelante «el Convenio»), el 22 de junio de 2009, por Don Antonio Aldeguer Tomás (en adelante «el demandante»), de nacionalidad española.

El demandante reclamaba de conformidad con el artículo 14 del Convenio junto con el artículo 8, que había sido discriminado en base a su orientación sexual al habérsele denegado la pensión de viudedad después del fallecimiento de su compañero, con quien había vivido en una relación marital de hecho durante doce años. ANTECEDENTES DE HECHO
I. CIRCUSTANCIAS DEL CASO
7. El Demandante convivió con otro hombre en una relación homosexual desde 1990 hasta el fallecimiento de este el 2 de julio de 2002. Durante este periodo ambos residieron en un apartamento propiedad de la pareja del demandante. Tras la muerte de la pareja del demandante, la hermana de este y única heredera del fallecido, cedió al demandante un apartamento propiedad del fallecido en el que la pareja había disfrutado de sus vacaciones desde 1990, debido a la relación que este había mantenido con su hermano.
8. El 19 de septiembre de 2003 el demandante solicitó prestaciones a la seguridad social como cónyuge supérstite, en base al artículo 174.1 de la Ley General de la Seguridad Social, defendiendo que había cohabitado con su compañero durante muchos años.
9. El 22 de septiembre de 2003 el Instituto Nacional de la Seguridad Social (en adelante «INSS») le denegó dicha pensión de viudedad alegando que ya que el demandante no había contraído matrimonio con el fallecido, no se le podía considerar cónyuge supérstite en base a la legalidad para poder atenerse a lo incluido en el artículo 174.1 de la Ley General de la Seguridad Social. Esta decisión fue notificada formalmente el 13 de junio de 2005.10. El 1 de julio de 2005 se aprobó la Ley 13/2005, por la que se modifica el Código Civil en materia de derecho a contraer matrimonio, que entró en vigor dos días después. Esta ley daba validez legal al matrimonio entre personas del mismo sexo en España. De acuerdo con su primera disposición adicional, todas las disposiciones legales y regulatorias pertinentes al matrimonio deberán ser entendidas en adelante como aplicables a todos los matrimonios, independientemente del sexo de sus componentes (véase párrafo 35 más adelante).
11. El 5 de julio de 2005, el demandante elevó una reclamación contra la decisión del 22 de septiembre de 2003. Esta reclamación fue desestimada por el INSS el 11 de agosto de 2005. El INNS afirmó que no había ningún precepto en la legislación en vigor que permitiera, en lo referente a los derechos de seguridad social, a quien hubiera convivido con el fallecido, obtener el estado de viudo.
12. El 26 de septiembre de 2005 el demandante recurrió esta sentencia ante el Tribunal de lo Social de Madrid n.º 33 (en adelante, «el Tribunal de lo Social»).
13. En una sentencia del 14 de noviembre de 2005 el Tribunal de lo Social falló a favor del demandante. Este Tribunal remarcó que los hechos del caso debían ser analizados en consideración con la recién aprobada Ley 13/2005, que ya era aplicable y que el Tribunal consideraba constitucional. En lo referente al fondo, el Tribunal de lo Social observó que el problema en este caso era si el demandante tenía el derecho a la pensión de viudedad por ser el superviviente de una pareja del mismo sexo que acabó (debido al fallecimiento de su pareja) antes de que la Ley 13/2005 entrara en vigor. El Tribunal de lo Social reiteró que, según la jurisprudencia interna vigente, los miembros supérstites de parejas no casadas no tenían derecho a pensión de viudedad en base al artículo 174 de la Ley General de Seguridad Social, ya que el matrimonio es un requisito constitutivo para poder acceder a cualquier beneficio de este tipo de la Seguridad Social. También reiteró que el demandante no había podido casarse con su pareja porque el matrimonio entre parejas del mismo sexo no se había aprobado en la legislación en el momento de la muerte de su pareja y que la administración de la Seguridad Social se había basado en el hecho de que la pareja no se hubiera casado para denegarle la ayuda y que era evidente que, después de la entrada en vigor de la Ley 13/2005 los cónyuges supérstites de parejas del mismo sexo tuvieran los mismos derechos que los supérstites de parejas heterosexuales.

PRESCHOOL EDUCATION
OBJECTIVE OF THE PROJECT: This program aims at providing formal and non-formal education and adequate daily nutrition to the children of slums in the age group of 2-6 years old, for their holistic and healthy physical and mental growth.
ACTIVITIES OF THE YEAR:
In the year 2016-17, a total of 982 children were enrolled into the 30 preschool education centres (26 physical centres with 4 of them running in double shifts). Unfortunately, 55 of them dropped out due to various reasons such as migration, parents’ dispute etc. Below are all the activities of this project for the past year:
1. Enrollment Process
The admission process for the new academic year started with a complete house to house survey to spread awareness about the need for preschool education centres in slum communities, following which students were admitted keeping in mind the pre-requisites such as low income of family. Post their admission, uniforms, bags, water bottles and educational materials (books, stationary etc.) were provided to all the students.
2. Self-Help Groups for Nutrition
This project collaborated with 17 Self-Help Groups or SHGs (small groups formed by 10-20 women living in same underprivileged communities with the objective to collectively accept work assignments and contribute to a common savings fund in order to become financially independent and to be able to lend to their community members as well, to meet their productive and emergent needs), comprising of a total of 255 women, who cooked and provided the pre-decided rotating set menu for each day of the week at all the preschool education centres. The same model was used to provide nutrition to the girls of Life Skills Empowerment project as well.

ACTIVIDADES DE ESTE AÑO:
En el año 2016-17, se matriculó el total de 982 niños en los 30 centros de educación infantil (26 centros físicos, de los cuales 4 ofrecían dobles turnos). El proceso de admisión para el nuevo curso académico comenzó con una encuesta completa casa por casa, para concienciar acerca de la necesidad de los centros de educación infantil en comunidades pobres. Después, los estudiantes fueron admitidos teniendo en cuenta los pre-requisitos, como la baja renta de la familia. Después de su admisión, se proporcionó a todos los estudiantes uniformes, mochilas, botellas de agua y material educativo (libros, material escolar, etc.).
2. Grupos de Auto Ayuda para la Nutrición
Este proyecto contó con la colaboración de 17 Grupos de Auto Ayuda para la Nutrición (SHG, por sus siglas en inglés), que consisten en pequeños grupos de entre 10 y 20 mujeres que provienen de las mismas comunidades desfavorecidas, llegando a las 225 mujeres, que se encargaron de cocinar y repartir un menú preestablecido de forma rotativa para cada día de la semana en los centros de educación infantil. El objetivo de estos grupos es aceptar trabajos colectivamente y contribuir a la creación de un fondo común de ahorros para poder ser independientes económicamente y poder hacer préstamos a otros miembros de la comunidad, cumpliendo con sus necesidades productivas y emergentes. Este mismo modelo se empleó para proporcionar nutrición a las niñas del proyecto para el destrezas para la vida diaria, Life Skills Empowerment.
