[i]Why does Rapid Realty reward employees for getting the company’s logo tattooed anywhere on their body?[/i]
The concept of the “human billboard” is not exactly novel. We have all seen people sandwiched between a couple of boards, or racers proudly wearing dozens of logos all over their clothes. It is only logical the next step would be logos tattooed directly on someone’s body.
In 2003, one Jim Nelson tattooed the logo of hosting company CI Host on the back of his head for $7,000, and since then the concept has regularly been used by multiple companies.
However, the campaign real estate company Rapid Realty decided to pull is completely different, though superficially similar on the surface. Employees of the company have the option to have the company’s logo tattooed on their body to receive a 15% pay raise. There are, however, two substantial differences between this new campaign and everything that has been done before: first, only employees of the company are eligible, and second, there are no restrictions regarding where the logo should be situated on the body or how big it should be – and let’s admit it, a small tattoo behind the ear is not going to do much advertising at all. So, what’s the deal here?
The answer may lie in the properties of a tattoo. Permanent tattoos are notoriously difficult to remove, which means that getting tattooed is a fairly big commitment: if you don’t want it anymore, too bad. This is probably just what Rapid Realty seeks to exploit. A picture of two fused Rs is not exactly as awesome as your average scorpion or dragon, in other words, it’s probably not something you would wear on your body for the kicks of it. It’s all about the pay raise. Were you to leave the company, you’re stuck with it, and it’s no longer making you any money at all. For this reason, the tattoo is a token of loyalty of sorts, making you less willing to leave the company. In a nutshell, Rapid Realty “brands” their employees with a mark that shall forever indicate their belonging to the firm in an attempt to ensure they don’t leave. Now think of the way livestock owners brand their cows and sheep with a hot iron to indicate that these animals are their property to avoid losing them, and suddenly this campaign may start sounding just a little creepy.
Now let’s make it perfectly clear, far be it from me to imply Rapid Realty thinks of their employees as mere cattle, but assuming you have watched almost any science-fiction movie ever, you can’t honestly tell me this procedure doesn’t bring to mind any images of a dystopian future where slavery is reinstated.

• You are paid every week by direct deposit to your bank account. Friday is pay day for the previous week of work. (unless a bank holiday occurs on Friday, in which case payday will be Thursday).

ENTENTE SUR LES HEURES DE TRAVAIL SUPPLÉMENTAIRES
La Loi sur les normes d’emploi 2000 (“ESA 2000”) stipule que désormais un employé et un employeur doivent conclure une entente par écrit afin de permettre à l’employé de travailler jusqu’à 60 heures par semaine.
Afin d’assurer la conformité avec l’ESA 2000 et de pouvoir travailler jusqu’à 60 heures par semaine, je, soussigné, conformément à la section 17 de l’ESA 2000, accepte de travailler en-dessus des:

RÉMUNÉRATION:

• Afin de vous payer, nous nécessitons un formulaire TD1 complété, un chèque annulé ou un imprimé de votre banque indiquant le nom de la banque, son emplacement, le numéro de domiciliation et le numéro de compte, ainsi que votre numéro d’assurance sociale.
• Le premier paiement ne sera pas émis si nous n’avons pas votre information bancaire complète et numéro d’assurance sociale.

DISPONIBILITÉ

ABSENTÉISME:
Une fois que vous avez accepté une assignation, il est attendu de vous que vous ne manquiez pas des périodes de travail. Si vous devez manquer une période de travail pour quelconque raison, contactez [l'Entreprise] et l’entreprise à laquelle vous avez été assigné immédiatement. Si vous planifiez être absent à l’avenir, veuillez nous en aviser le plus tôt possible, car les notifications à la dernière minute sont considérées comme inacceptables.
Toute absence du travail sans avis préalable sera considérée comme un motif valable pour une cessation immédiate de votre emploi, et vous n’aurez droit à aucun préavis de licenciement ni à une compensation financière en l’absence d’un tel préavis, ni droit à une indemnité de licenciement (le cas échéant) conformément au contrat, à la loi (incluant entre autres la Loi sur les normes d’emploi 2000) ou au droit commun.

APPARENCE PERSONNELLE

Pas de pantalons pyjama, pas de T-shirts ni de chapeaux portant des slogans offensifs, pas de shorts trop courts, pas de débardeurs, pas de T-shirts sans manches, toutes les chemises doivent être bordées, tous les pantalons doivent être portés sur ou au-dessus des hanches et ne doivent pas tomber si ils ne sont pas manuellement retenus. SANTÉ ET SÉCURITÉ
[L'Entreprise] et ses clients s’efforcent à fournir un environnement exempt de drogue, sain et sans danger. Nous nous attendons à ce que les employés se présentent au travail en bon état physique et mental afin de pouvoir accomplir leurs tâches. Il est interdit aux employés d’apporter ou d’utiliser des téléphones cellulaires, des iPods, des lecteurs MP3 ou d’autres appareils électroniques au travail. Il est également interdit aux employés d’apporter des armes de quelque sorte que ce soit au travail. Tout employé ce présentant au travail sous l’influence de l’alcool ou de la drogue sera prié de quitter les lieux immédiatement. Les individus travaillant dans un environnement nécessitant des chaussures de sécurité devront se procurer des chaussures de sécurité approuvées par la CSA (Association canadienne de normalisation). Pour les environnements où des lunettes de sécurité sont nécessaires, vous devrez vous procurer des lunettes de sécurité approuvées par la CSA. Certaines entreprises vous fourniront les lunettes elles-mêmes. [L'Entreprise] offre également des lunettes à 5.00 $ par paire (le montant sera déduit de votre paie).

• Des commentaires ou un comportement vexatoires (qui peuvent provoquer l’irritation ou l’inquiétude, ou être considéré comme troublants, provocateurs, agaçants, problématiques ou gênants) contre un travailleur dans un lieu de travail, de la part d'une personne qui sait ou qui devrait raisonnablement savoir que de tels commentaires ou un tel comportement sont inappropriés ou non désirés.
RESPONSABILITÉS DES ASSOCIÉS
Tous nos associés sont tenus de suivre notre politique sur la violence et le harcèlement au travail. Si un associé croît avoir été victime de violence ou de harcèlement ou avoir assisté à un cas de violence ou de harcèlement, cet associé est responsable de signaler l’incident à [l'Entreprise]. Tous les associés ont la responsabilité de signaler la violence et le harcèlement, qu’ils aient été directement impliqués ou non.
Dans le cas où [l'Entreprise] aurait à conduire une enquête sur une allégation de violence or de harcèlement impliquant un associé, il sera attendu que ledit associé coopère avec l’enquête. Toute enquête sera conduite de manière juste et la ou les personnes suspectées d’avoir commis des actions violentes ou harcelantes auront pleinement la possibilité de répondre aux accusations avant que des conclusions soient tirées.
RAPPORTER LA VIOLENCE ET LE HARCÈLEMENT AU TRAVAIL
En cas de danger immédiat, appelez la police ou composez le 911.
Quiconque croît être victime ou témoin d’un cas de violence ou de harcèlement devrait le signaler immédiatement à [l'Entreprise]. Les associés doivent remplir un formulaire fourni par [l'Entreprise] pour informer [l'Entreprise] des incidents de violence ou de harcèlement au travail. Le rapport d’incident devrait contenir au moins :
• La date et le temps de l’incident
• Le nom de la ou des personne(s) concernées
• L’emplacement de l’incident
• Ce qui a conduit à l’incident
• Ce qui s’est passé durant l’incident
• Qui a été témoin de l’incident
• À qui l’incident a été signalé
• Quelles mesures ont été prises
• Si l’incident a entrainé des blessures
ENQUÊTE
Tout cas de violence ou de harcèlement signalé fait l’objet d’une enquête complète. Cette enquête est menée rapidement, avec soin et discrétion, et est gardée aussi confidentielle que possible. Une réponse est envoyée à l’associé qui a rempli le rapport dans un délai de trente (30) jours suivant la réception du rapport par [l'Entreprise]. Si l’associé ne reçoit pas de réponse dans ce délai, ou reçoit une réponse insatisfaisante, l’associé peut contacter le contrôleur à [l'Entreprise].

• Nous veillons à ce que vous soyez traité de manière juste au lieu de travail auquel vous êtes assigné.
• Nous veillons à ce que vous ne soyez pas victime de violence ou d’harassement au lieu de travail auquel vous êtes assigné.
• Nous veillons à ce que vous vous sentiez en sécurité, physiquement et psychologiquement, au lieu de travail auquel vous êtes assigné.
• Nous veillons à ce que vous receviez de l’aide au lieu de travail auquel vous êtes assigné au besoin. Cela inclut entre autres l’information, la formation, les outils ou équipement, et l’assistance physique de la part d’une autre personne.
Si vous éprouvez des problèmes au lieu de travail auquel vous êtes assigné, veuillez nous en faire part immédiatement. Nous pouvons vous soutenir, mais vous êtes responsable de nous informer. En cas de doute, n’hésitez pas à nous poser des questions.
