1. Criminal proceedings for bodily injury
35. As already mentioned above (see paragraph 21), on 30 March 2011 the State Attorney indicted the first applicant’s father before the Zadar Municipal Court for having committed the criminal offence of bodily injury defined in Article 98 of the Criminal Code (see paragraph 86 below) during the incident of 1 February 2011.
36. On 19 April 2011 the court issued a penal order (kazneni nalog), finding him guilty as charged and imposing a fine of HRK 1,820.
37. On 4 May 2011 the first applicant’s father challenged the penal order, arguing that the basis on which it had been issued was false. The court accordingly set aside the penal order, and the proceedings resumed under the rules of summary criminal procedure.
38. The hearing scheduled for 7 May 2013 was adjourned because neither the accused nor the summoned witnesses attended it.
39. At the hearing held on 6 June 2013 the first applicant’s father pleaded not guilty and made a statement. He also proposed that several witnesses be heard. The applicants proposed that they themselves be heard.
40. At the hearing held on 23 July 2013 the court heard the second applicant, one of the police officers who had interviewed the applicants following the incident of 1 February 2011, the first applicant’s schoolteacher, and Z.M., a psychologist who had acted as supervising officer during the implementation of the first child protection measure in respect of the supervision of the exercise of parental authority (see paragraph 11 above).
41. The police officer stated that she had not noticed any visible injuries on the first applicant during the interview with her the day after the incident of 1 February 2011. The first applicant’s schoolteacher had not seen any injuries either. He also testified that he had noticed that the first applicant had seemed sad the day after the incident and that he had talked to her about this; the first applicant had told him on that occasion that her father had not hit her. Z.M., who said that he had spoken with the first applicant some time after the incident in the capacity of a private individual and at her father’s request, testified that the first applicant had told him that her father had yelled at her and that she had been afraid that he would hit her but that he had not. He also stated that as a school psychologist he knew very well how to recognise signs of abuse in children and that the first applicant had not shown such signs.
42. On 25 July 2013 the court decided to obtain an expert opinion from a medical expert on the first applicant’s injuries.
43. The hearing scheduled for 18 September 2013 was adjourned because the summoned witnesses failed to attend it.
44. On 23 September 2013 the expert submitted his opinion, which stated that it was possible, but could not be determined with certainty, that the first applicant’s injury had been sustained during the incident of l February 2011. The relevant part of his opinion states as follows:
“The following injury was established [at the time] by medical examination:
small haematoma of the left lower eyelid.
This injury constitutes a bodily injury.
The injury was inflicted by some hard and blunt object. It was inflicted by a single blow of low intensity.
The mechanism of the injury could correspond to the course of events as they were described to the doctor by the injured party during the examination (a blow with the hand to the eye).
However, it is to be noted that the injury was described by the doctor who performed the examination as a haematoma in resorption, thus in [the process of] disappearing, fading. That normally happens after a certain period of time, for example, several days, after an injury. It would not be common for resorption to already be visible the day after the injury.
It follows from the above that the injury could have been inflicted during the incident in question, but that a causal link cannot be established with certainty.”
45. At the hearing held on 24 October 2013 the court heard the other police officer who had interviewed the first applicant on 2 February 2011, the social worker who had been present during the interview with the police, and the doctor who had examined her on that day.
46. The police officer testified that the first applicant did indeed not want to return to her father and that the social worker from the local social welfare centre had indeed told her that they would have to temporarily place her in a children’s home if she refused. She also testified that she had not seen any signs of injury on the first applicant. The social worker testified that she had not noticed any signs of injury on the first applicant either. She also stated that while it was true that the first applicant had not wanted to return to her father, she had changed her mind after they spoke, in the course of which she had not mentioned the alternative of sending the first applicant to a children’s home. The doctor who examined the first applicant stated that resorption of a haematoma occurred more quickly in children and young people. While he excluded the possibility that the injury could have been caused by crying and rubbing the eyes he did not rule out the possibility that it had been caused by, for example, the first applicant being hit by the ball during her volleyball practice. The applicants’ representative reiterated their proposal that the first applicant be heard.
47. In order to decide on that proposal, the court decided to consult the case file concerning the above-mentioned custody proceedings (see paragraph 22 above and 60-81 below). Eventually, the court decided to hear the first applicant via video link on 1 July 2014.
48. However, that hearing was adjourned because on 30 June 2014 the first applicant’s father sought withdrawal of the trial judge; that application was dismissed by the court’s president on 3 July 2014.
49. Since none of the courts in Zadar was equipped with a video link device, the court asked the police authorities to provide it. The police informed the court that it would make available a video-link device on 16 October 2014. Accordingly, the examination of the first applicant was scheduled for that date.
50. However, on 14 October 2014 the police authorities informed the court that they would not be able to provide the device on 16 October 2014.
51. According to the Government, the proceedings are still pending, depending on the availability of the video link device.
2. The applicants’ attempts to institute criminal proceedings against the first applicant’s father for child abuse
52. Meanwhile, on 27 April 2011 the second applicant lodged a criminal complaint with the State Attorney against the first applicant’s father accusing him of the criminal offence of child abuse as defined in Article 213 paragraph 2 of the Criminal Code (see paragraph 86 below). In particular, the second applicant argued that he had physically and psychologically abused the first applicant by: (a) in the period between February 2008 and April 2011, inter alia, swearing at her and calling her names, frequently forcing her to eat food she did not like, and force-feeding her when she refused, threatening to hit her, cut off her long hair and ensure that she never saw or heard from her mother, hitting her with a hairbrush on one occasion, among others, and (b) on 1 February 2011 hitting the first applicant several times in the face and squeezing her throat while verbally abusing her, as a result of which she was later diagnosed by an ophthalmologist with bruising of the eyeballs and eye-socket tissue.
53. On 20 June 2011 the State Attorney asked the of the Zadar County Court (Županijski sud u Zadru) investigating judge to: (a) question the suspect, (b) take statements from his partner and from the second applicant and her partner, and (c) order a combined expert opinion from experts in psychiatry and psychology.
54. On 29 September 2011 the State Attorney’s Office itself ordered a combined expert opinion from certain court experts in psychiatry and psychology. On 4 October 2011 it set that order aside after finding that such a combined expert opinion had already been obtained in the context of the above-mentioned custody proceedings (see paragraph 22 above and paragraphs 60-81 below).
55. On 16 January 2012 the State Attorney dismissed the second applicant’s criminal complaint, finding that there were not sufficient grounds to suspect that the first applicant’s father had committed the criminal offence the second applicant had accused him of. In so doing the State Attorney’s Office addressed only the part of her complaint concerning the alleged abuse of the first applicant in the period between February 2008 and April 2011, and not the part concerning the incident of 1 February 2011. After examining the statements made to the police by the suspect and his partner, the second applicant and her partner, psychiatrists’ opinions of 19 February and 7 May 2011, the psychologist’s opinion of 5 March 2011, and the combined expert opinion of 29 December 2011 (see paragraphs 16-17, 19-20 and 25 above and paragraphs 69-70 below), the State Attorney gave the following reasons for his decision:
“Analysing the above facts, it follows that the suspect I.M.’s conduct or the conduct of [the second applicant] cannot be regarded as conscious and deliberate emotional or physical child abuse, but rather as inadequate child-rearing practice [ parenting style] and reaction caused by parental conflict over child custody, persistence of long-lasting mutual unresolved conflicts, and limited parenting capacity ...
In view of the foregoing ... there is no reasonable suspicion that the suspect I.M. committed the criminal offence he is accused of ...”
56. The first and second applicants then decided to take over the prosecution from the State Attorney as injured parties in the role of (subsidiary) prosecutors. As the Criminal Procedure Act requires that an accused be questioned before being indicted, on 25 January 2012 the applicants asked an investigating judge (sudac istrage) of the Zadar County Court to question the first applicant’s father.
57. By a decision of 9 February 2012 the investigating judge dismissed the applicants’ request, holding that the facts adduced by the applicants did not constitute the criminal offence of child abuse. In so doing he relied on the combined expert opinion of the forensic experts in psychiatry and psychology of 29 December 2011 obtained in the custody proceedings (see paragraphs 69-70 below). The relevant part of that decision reads as follows:
“... the conduct cannot be regarded as abuse [because the combined expert opinion] did not confirm the diagnosis of child abuse. This is very strongly indicated by the recommendation that changing the child’s residence is not advisable. Had that diagnosis been established, the recommendation concerning the child’s residence would have certainly been very different.”
58. On 21 February 2012 a three-member panel of the Zadar County Court dismissed an appeal by the applicants against the decision of the investigating judge. The relevant part of that decision reads as follows:
“[The child is under supervision] by the [local] social welfare centre. It is therefore evident that if the suspect had behaved in an unseemly or inappropriate manner towards her as a parent that the centre would have reacted. There must have been reasons why the father was awarded care of the child. If there is any change in circumstances that decision could also be changed. According to the expert opinion no elements of abuse were found ...”
59. On 24 May 2012 the Constitutional Court (Ustavni sud Republike Hrvatske) declared inadmissible a subsequent constitutional complaint by the applicants. It held that the contested decisions of the Zadar County Court were not susceptible to constitutional review. The Constitutional Court served its decision on the applicants’ representative on 3 July 2012.

1. Proceso penal por lesiones corporales
35. Como se mencionó anteriormente (véase el párrafo 21), el 30 de marzo de 2011, la Fiscalía imputó al padre de la primera demandante ante el Juzgado Municipal de Zadar por haber cometido el delito de lesiones corporales tipificado en el artículo 98 del Código Penal (véase el párrafo 86 infra) durante el incidente del 1 de febrero de 2011.
36. El 19 de abril de 2011, el tribunal dictó una orden penal (kazneni nalog), que lo declaraba culpable del cargo y le impuso una multa de 1820 HRK.
37. El 4 de mayo de 2011, el padre de la primera demandante impugnó la orden penal, alegando que la base sobre la que se habría emitido era falsa. En consecuencia, el tribunal anuló la orden penal y se reanudó el procedimiento en virtud de las reglas de procedimiento penal sumario.
38. La audiencia prevista para el 7 de mayo de 2013 se pospuso porque no asistieron ni el acusado ni los testigos citados.
39. Durante la audiencia celebrada el 6 de junio de 2013, el padre de la primera demandante se declaró inocente y formuló una declaración. También propuso que se escuchara a varios testigos. Las demandantes propusieron que se les escuchara a ellas mismas.
40. Durante la audiencia celebrada el 23 de julio de 2013, el tribunal escuchó a la segunda demandante, a una de las agentes de policía que había entrevistado a las demandantes tras el incidente del 1 de febrero de 2011, al maestro de la primera demandante y a Z. M., un psicólogo que había actuado como funcionario supervisor durante la implementación de la primera medida de protección del menor con respecto a la supervisión del ejercicio de la patria potestad (véase el párrafo 11 supra).
41. La agente de policía declaró que no se había percatado de ninguna lesión visible en la primera demandante durante la entrevista con ella el día tras el incidente del 1 de febrero de 2011. El maestro de la primera demandante dijo que tampoco había visto ninguna lesión. También testificó que se había percatado de que la primera demandante parecía triste el día después del incidente y que había hablado con ella; la primera demandante le dijo en esa ocasión que su padre no la había golpeado. Z. M., que dijo que había hablado con la primera demandante algún tiempo después del incidente a título personal y a petición de su padre, testificó que la primera demandante le había dicho que su padre le había gritado y que tenía miedo de que le pegara pero que no lo había hecho. También declaró que, como psicólogo escolar, sabía muy bien cómo reconocer los signos de maltrato en menores y que la primera demandante no mostraba dichos signos.
42. El 25 de julio de 2013, el tribunal decidió obtener un dictamen pericial de un médico forense sobre las lesiones de la primera demandante.
43. La audiencia prevista para el 18 de septiembre de 2013 se pospuso porque los testigos citados no asistieron.
44. El 23 de septiembre de 2013, el perito presentó su dictamen, que declaró que era posible, pero no podía determinarse con certeza, que la lesión de la primera demandante se hubiera producido durante el incidente del 1 de febrero de 2011. La parte pertinente de su dictamen dice lo siguiente:
«La siguiente lesión se estableció [en dicho momento] en el examen médico:pequeño hematoma del párpado inferior izquierdo. Esta lesión constituye una lesión corporal.
La lesión fue producida por un objeto duro y contundente. Se produjo con un solo golpe de baja intensidad.
El mecanismo de la lesión podría corresponder con el transcurso de los acontecimientos que la parte lesionada describió al médico durante el examen (un golpe en el ojo con la mano).
Sin embargo, cabe destacar que el médico que llevó a cabo el examen describió la lesión como un hematoma en reabsorción, es decir, en [proceso de] desparecer, desvanecerse. Esto normalmente ocurre después de cierto tiempo, por ejemplo, algunos días después de una lesión. No sería habitual que pudiera verse reabsorción el día después de la lesión.
De lo anterior se desprende que la lesión puedo haberse producido durante el incidente en cuestión pero que no se puede establecer ninguna causalidad con certeza».
45. Durante la audiencia celebrada el 24 de octubre de 2013, el tribunal escuchó a la otra agente de policía que entrevistó a la primera demandante el 2 de febrero de 2011, a la asistente social que había estado presente durante la entrevista con la policía y al médico que la había examinado ese día.
46. La agente de policía testificó que la primera demandante no quería volver con su padre y que la asistente social del centro local de asistencia social le había dicho que tendrían que llevarla temporalmente a un centro de acogida si se negaba. También declaró que no había visto señales de lesión en la primera demandante. La asistente social declaró que tampoco se había percatado de ninguna señal de lesión en la primera demandante. También declaró que, aunque era verdad que la primera demandante no quería volver con su padre, cambió de opinión después de que hablaran, durante lo cual no había mencionado la alternativa de enviar a la primera demandante a un centro de acogida. El médico que examinó a la primera demandante declaró que la reabsorción de un hematoma ocurre más rápidamente en niños y jóvenes. Aunque excluía la posibilidad de que la lesión se hubiera podido producir por llorar y frotarse los ojos, no descartaba la posibilidad de que se hubiese producido, por ejemplo, si una pelota hubiese golpeado a la primera demandante durante sus prácticas de voleibol. La representante de las demandantes reiteró su propuesta de que se escuchara a la primera demandante.
47. Para tomar una decisión sobre esta propuesta, el tribunal decidió consultar los autos relativos al procedimiento de custodia anterior (véase el párrafo 22 supra y los párrafos 60-81 infra). Finalmente, el tribunal decidió escuchar a la primera demandante por videoconferencia el 1 de julio de 2014.
48. Sin embargo, esta audiencia se suspendió debido a que, el 30 de junio de 2014, el padre de la primera demandante solicitó la retirada del juez del caso; dicha solicitud fue desestimada por el presidente del tribunal el 3 de julio de 2014.
49. Ya que ninguno de los juzgados en Zadar contaba con equipos de videoconferencia, el tribunal solicitó a las autoridades policiales que los proporcionaran. La policía informó al tribunal que le proporcionaría un equipo de videoconferencia el 16 de octubre de 2014. Por consiguiente, el interrogatorio de la primera demandante estaba previsto para dicha fecha.
50. Sin embargo, el 14 de octubre de 2014, las autoridades policiales informaron al tribunal que no podrían proporcionar el equipo el 16 de octubre de 2014.
51. Según el Gobierno, el procedimiento sigue pendiente, en función de la disponibilidad del equipo de videoconferencia.
2. Los intentos de las demandantes de incoar un procedimiento penal contra el padre de la primera demandante por maltrato infantil
52. Mientras, tanto, el 27 de abril de 2011, la segunda demandante presentó una denuncia penal contra el padre de la primera demandante ante la Fiscalía, acusándolo del delito de maltrato infantil tipificado en el artículo 213 apartado 2 del Código Penal (véase el párrafo 86 infra). Específicamente, la segunda demandante alegó que había maltratado a la primera demandante física y psicológicamente: (a) entre febrero de 2008 y abril de 2011, entre otras cosas, diciéndole malas palabras e insultándola, obligándola a comer comida que no le gustaba y forzándola a comer cuando se negaba, amenazándola con pegarle, cortarle su pelo largo y asegurarse de que nunca viera o supiera de su madre, pegándole con un cepillo en una ocasión, entre otras cosas, y (b) el 1 de febrero de 2011, pegándole a la primera demandante varias veces en la cara y apretándole la garganta mientras la maltrataba verbalmente, resultando en un diagnóstico de lesión en el globo ocular y el tejido orbitario por parte de un oftalmólogo.
53. El 20 de junio de 2011, la Fiscalía solicitó al juez de instrucción del Tribunal Provincial de Zadar (Županijski sud u Zadru) que: (a) interrogara al sospechoso, (b) tomara declaración de la pareja de este y de la segunda demandante y su pareja, y (c) solicitara un dictamen pericial combinado de expertos en psiquiatría y psicología.
54. El 29 de septiembre de 2011, la Fiscalía solicitó un dictamen pericial combinado de ciertos peritos judiciales en psiquiatría y psicología. El 4 de octubre de 2011, anuló dicha orden después de percatarse de que ya se había obtenido un dictamen pericial combinado durante el procedimiento de custodia mencionado anteriormente (véase el párrafo 22 supra y los párrafos 60-81 infra).
55. El 16 de enero de 2012, la Fiscalía desestimó la denuncia penal de la segunda demandante, declarando que no había fundamentos suficientes para sospechar que el padre de la primera demandante habría cometido el delito del que lo acusaba la segunda demandante. Al hacer esto, la Fiscalía solo se refería a la parte de su denuncia que versaba sobre el supuesto maltrato de la primera demandante entre febrero de 2008 y abril de 2011 y no la parte correspondiente al incidente del 1 de febrero de 2011. Tras examinar las declaraciones hechas ante la policía por parte del sospechoso y su pareja, la segunda demandante y su pareja, las opiniones de los psiquiatras del 19 de febrero y el 7 de mayo de 2011, el dictamen de la psicólogo del 5 de marzo de 2011 y el dictamen pericial combinado del 29 de diciembre de 2011 (véanse los párrafos 16-17, 19-20 y 25 supra y los párrafos 69-70 infra), la Fiscalía proporcionó las siguientes razones para su decisión:
«Del análisis de los hechos anteriores, se desprende que la conducta del sospechoso,
I. M., o la conducta de [la segunda demandante] no pueden considerarse maltrato infantil emocional o físico consciente y deliberado, sino más bien prácticas de crianza inadecuadas [estilos de crianza] y una reacción al conflicto entre los progenitores sobre la custodia de la menor, la persistencia de conflictos mutuos sin resolver durante mucho tiempo y su limitada capacidad de crianza [...].
En vista de lo anterior [...] no hay sospechas razonables de que el sospechoso, I. M., haya cometido el delito del que se le acusa [...]».
56. La primera y la segunda demandantes entonces decidieron asumir la acusación de la Fiscalía como partes perjudicadas en la capacidad de fiscales (subsidiarios). Ya que la Ley de Enjuiciamiento Penal exige que se interrogue a un acusado antes de incoarse un procedimiento, el 25 de enero de 2012, los solicitantes solicitaron al juez de instrucción (sudac istrage) del Tribunal Provincial de Zadar que interrogara al padre de la primera demandante.
57. Mediante resolución de 9 de febrero de 2012, el juez de instrucción desestimó la solicitud de las demandantes, considerando que los hechos alegados por las demandantes no constituían un delito de maltrato infantil. Al hacerlo, se basó en el dictamen pericial combinado de los expertos forenses en psiquiatría y psicología del 29 de diciembre de 2011 obtenido durante el procedimiento de custodia (véanse los párrafos 69-70 infra). La parte pertinente de dicha resolución establece lo siguiente:
«[...] la conducta no puede considerarse maltrato [ya que el dictamen pericial combinado] no confirmó el diagnóstico de maltrato infantil. Esto se deduce claramente de la recomendación de no cambiar el domicilio de la niña. Si se hubiese establecido dicho diagnóstico, la recomendación sobre el domicilio de la niña seguramente habría sido muy distinta».
58. El 21 de febrero de 2012, un panel de tres miembros del Tribunal Provincial de Zadar desestimó el recurso de las demandantes contra la resolución del juez de instrucción. La parte pertinente de dicha resolución establece lo siguiente:
«[La niña se encuentra bajo la supervisión] del centro de asistencia social [local]. Por tanto, es evidente que, si el sospechoso se hubiese comportado de manera impropia o inapropiada con ella como padre, el centro hubiese reaccionado. Tiene que haber razones por las que la custodia de la niña se adjudicó al padre. Si se da algún cambio en las circunstancias, también podría cambiarse dicha decisión. Según el dictamen pericial, no se encontraron elementos constitutivos de maltrato [...]».
59. El 24 de mayo de 2012, el Tribunal Constitucional (Ustavni sud Republike Hrvatske) declaró inadmisible un recurso constitucional posterior de las demandantes. Sostuvo que las decisiones impugnadas del Tribunal Provincial de Zadar no estaban sujetas a revisión constitucional. El Tribunal Constitucional notificó a la representante de las demandantes de su decisión el 3 de julio de 2012.

Source text - Spanish 1. En la sentencia Coty Germany, (2) el Tribunal de Justicia se enfrentó a uno de los problemas que suscitan «las plataformas de terceros para vender en internet los productos [de lujo]», en el marco de un sistema de distribución selectiva. En aquel asunto lo que se dirimía era la validez de la prohibición de recurrir a esas plataformas (o a terceras empresas para las ventas por internet), impuesta a los distribuidores autorizados de ciertos productos cosméticos, para preservar su imagen de lujo.
2. La misma empresa que estaba en el origen de aquel litigio (Coty Germany GmbH) ha planteado ante los tribunales alemanes una demanda que también afecta a la actuación de las plataformas de comercio electrónico, en particular, de una de las más conocidas, Amazon. A su juicio, ciertas empresas del grupo Amazon han violado el derecho que corresponde al titular de una marca de la Unión de prohibir a un tercero el uso del signo. (3) La infracción se habría cometido al intervenir dichas empresas, sin autorización del titular, en la venta de un perfume protegido por la marca, de la que Coty Germany es licenciataria.
3. El Bundesgerichtshof (Tribunal Supremo de lo civil y penal, Alemania), que ha de resolver en último término el litigio tras las sentencias dictadas por un órgano judicial de instancia y otro de apelación, eleva al Tribunal de Justicia sus dudas sobre la interpretación del artículo 9, apartado 2, del Reglamento (CE) n.º 207/2009, (4) que delimita los derechos del titular de la marca de la Unión. (5)
I. Marco normativo. Reglamento (UE) 2017/1001 (6)
4. El Reglamento 2017/1001 codificó y sustituyó al Reglamento n.º 207/2009, que era el aplicable en el momento de producirse los hechos del litigio. El tribunal de reenvío se refiere a ambos, poniendo de relieve que, dada la naturaleza de la acción procesal entablada, ha de aplicarse el que ahora está en vigor. En todo caso, el precepto relevante para este asunto (7) no ha sufrido variación sustancial en ninguno de los dos Reglamentos.
5. El artículo 9 («Derechos conferidos por la marca de la Unión») prescribe:
«1. El registro de una marca de la Unión conferirá a su titular derechos exclusivos.
2. Sin perjuicio de los derechos de los titulares adquiridos antes de la fecha de presentación de la solicitud o la fecha de prioridad de la marca de la Unión, el titular de esta estará facultado para prohibir a cualquier tercero, sin su consentimiento, el uso en el tráfico económico de cualquier signo en relación con productos o servicios cuando:
a) el signo sea idéntico a la marca de la Unión y se utilice en relación con productos o servicios idénticos a aquellos para los que la marca de la Unión esté registrada;
[…]
3. Cuando se cumplan las condiciones enunciadas en el apartado 2, podrá prohibirse, en particular:
[…]
b) ofrecer los productos, comercializarlos o almacenarlos con dichos fines, u ofrecer o prestar servicios, con el signo;

II. Hechos del litigio, proceso ante los órganos jurisdiccionales nacionales y cuestión prejudicial
6. Coty Germany, que vende productos cosméticos en Alemania, es titular de una licencia de la marca de la Unión «DAVIDOFF», para «perfumería, aceites esenciales y cosméticos». En cuanto licenciataria, goza de la facultad (atribuida por la empresa titular del registro de la marca) de ejercer en su propio nombre los derechos derivados de aquel signo.
7. Amazon Services Europe S.a.r.l. (en lo sucesivo, «Amazon Services»), con domicilio social en Luxemburgo, brinda a terceros vendedores la posibilidad de publicar ofertas de sus productos en el sitio web amazon.de. Los contratos de compraventa de los productos comercializados de esa manera se formalizan entre los terceros vendedores y los compradores.
8. Los vendedores pueden participar en el programa «Logística de Amazon», (8) que implica tanto el almacenamiento de los productos en centros logísticos de empresas del grupo Amazon, como el envío de la mercancía al comprador y otros servicios adicionales.
9. El 8 de mayo de 2014, un comprador de prueba al servicio de Coty Germany adquirió, a través del sitio web amazon.de, el perfume «Davidoff Hot Water EdT 60 ml», que ofrecía la señora OE (en lo sucesivo, «vendedora») con la indicación «Versand durch Amazon» («Logística de Amazon»), pues la vendedora se había acogido a dicho programa.
10. Amazon Services había encargado a Amazon FC Graben GmbH (en lo sucesivo, «Amazon FC»), empresa del mismo grupo que explota un depósito de mercancías, con sede en Graben, Alemania, el almacenamiento de los productos de la vendedora.
11. Enterada de la venta de esos productos, Coty Germany conminó a la vendedora para que cesara en su oferta, alegando que el derecho de marca del perfume no se había agotado. En respuesta, la vendedora emitió una declaración de cesación, acompañada de una cláusula penal para el caso de incumplimiento.
12. Mediante escrito de 2 de junio de 2014, Coty Germany requirió a Amazon Services la entrega de todos los perfumes «Davidoff Hot Water EdT 60 ml» de la vendedora. Amazon Services le hizo llegar un paquete con treinta unidades de ese perfume. A raíz de que otra empresa del grupo Amazon comunicara que once de esas treinta unidades procedían de las existencias de un vendedor diferente, Coty Germany solicitó a Amazon Services que le facilitara el nombre y la dirección de aquel; añadía que, de los treinta perfumes recibidos, veintinueve correspondían a productos cuyo derecho de marca no se había agotado. Amazon Services le comunicó que no era posible precisar la empresa de cuyo inventario provenían las once unidades mencionadas.
13. Coty Germany, al entender que el comportamiento de Amazon Services y de Amazon FC infringía su derecho de marca, interpuso una acción para que se condenara a ambas empresas a cesar en la tenencia o en el envío del perfume provisto de la marca «Davidoff Hot Water», para su comercialización (eventualmente, por terceros) en el tráfico económico en Alemania.
14. La acción de cesación concernía a los productos no comercializados por el titular de la marca o por terceros con el consentimiento de este, en el territorio nacional, así como en cualquier otro Estado miembro de la Unión o parte del Acuerdo sobre el Espacio Económico Europeo. (9) Esa acción iba acompañada de la petición de resarcimiento de los daños (la indemnización solicitada era de 1 973,90 euros, más los intereses del 5 % desde el 24 de octubre de 2014).
15. Tanto la sentencia de primera instancia como la de apelación (10) rechazaron las pretensiones de Coty Germany. El tribunal de apelación sostuvo, en particular, que:
– Amazon FC no había hecho uso de la marca controvertida ni había poseído los perfumes con la finalidad de ofrecerlos o comercializarlos, sino que simplemente los había almacenado para la vendedora. En consecuencia, no cabía reputarla autora de una infracción ni obligarla a cesar en su conducta con respecto a los perfumes. Al no apreciarse que tuviera conocimiento de la falta de agotamiento del derecho de marca sobre el producto, no cabía imputarle una responsabilidad como coautora o como partícipe de una infracción de ese derecho.
– Amazon Services no había tenido en su poder las mercancías de la vendedora ni había enviado los productos controvertidos a sus compradores, por lo que, con mayor razón aún, debía ser exculpada.
16. Impugnada esa sentencia en casación («Revision») ante el Bundesgerichtshof (Tribunal Supremo de lo civil y penal), este órgano jurisdiccional señala que, habiendo ejercitado Coty Germany una acción de cesación, que presupone un riesgo de repetición, el recurso solo estará fundado si las actuaciones de las demandadas pudieran ser constitutivas de una infracción tanto en el momento en el que sucedieron como cuando se resuelva el recurso de casación.
17. Pues bien, el tribunal a quo necesita que se dilucide si, a la luz del artículo 9, apartado 3, letra b), del Reglamento 2017/1001, una persona que almacena productos que infringen un derecho de marca, sin tener conocimiento de dicha infracción, posee esos productos con el fin de ofrecerlos o de comercializarlos, cuando no es ella misma, sino un tercero, el que pretende ofertarlos o venderlos.
18. Para el tribunal remitente, esa duda merece una respuesta negativa, ya que:
– Según su propia jurisprudencia en materia de patentes, la mera tenencia o el transporte de productos con infracción de un derecho sobre patentes, realizados por un depositario, un transportista o un transitario, en general, no tiene lugar con el fin de ofrecerlos o comercializarlos. (11)
– No está justificado socavar los límites de la responsabilidad del poseedor, en virtud del artículo 9 de la Ley nacional de patentes, mediante la atribución de la intención del poseedor mediato al poseedor directo.
– Esa consideración es trasladable al derecho de marcas. Se ampliarían en exceso los límites de la responsabilidad del poseedor, con arreglo al artículo 9, apartado 3, letra b), del Reglamento 2017/1001, si, por la mera posesión de los productos infractores, se atribuyera esa responsabilidad al depositario que no tenga conocimiento de la infracción.
19. En esta tesitura, el Bundesgerichtshof (Tribunal Supremo de lo civil y penal) eleva al Tribunal de Justicia esta pregunta prejudicial sobre la interpretación del artículo 9, apartado 2, letra b), del Reglamento n.º 207/2009 y del artículo 9, apartado 3, letra b), del Reglamento 2017/1001:
«¿Posee una persona que almacena para un tercero productos que infringen un derecho de marca, sin tener conocimiento de dicha infracción, estos productos con el fin de ofrecerlos o comercializarlos, cuando no es ella misma sino solo el tercero el que pretende ofrecer o comercializar los productos?»
Translation - English 1. In the Coty Germany judgment (2), the Court of Justice faced one of the problems caused by “third-party platforms to sell [luxury] products on the Internet”, within the framework of a selective distribution system. In that case, the issue was the validity of the prohibition of resorting to such platforms (or to third parties for online sales) imposed upon the authorised distributors of certain cosmetic products, in order to preserve their luxury image.
2. The same company at the origin of that dispute (Coty Germany GmbH) has brought a lawsuit before the German courts that also affects the actions of e-commerce platforms, in particular Amazon, one of the best known. In its view, certain companies in the Amazon group have infringed upon the rights corresponding to the owner of an EU trade mark to prohibit a third party from using its sign. (3) The infringement would have been committed when said companies engaged in the sale of a type of perfume protected by a trade mark licensed to Coty Germany, without the owner's authorisation.
3. The Bundesgerichtshof (Federal Court of Justice, Germany), which is to decide ultimately on the dispute, following the judgments of a lower judicial body and an appellate body, has referred its questions to the Court of Justice regarding the interpretation of article 9(2), of Regulation (EC) no. 207/2009, (4), which defines the rights of a EU trade mark owner. (5)
I. Regulatory framework. Regulation (EU) 2017/1001 (6)
4. Regulation no. 2017/1001 codified and replaced Regulation no. 207/2009, which was applicable at the time that the facts in the main proceedings occurred. The referring court refers to both, highlighting that, given the nature of the procedural action brought, the one currently in force should be applied. In any case, the relevant precept in this case (7) has not undergone any substantial changes in either of the two Regulations.
5. Article 9 (“Rights conferred by an EU trade mark”) provides that:
“1. The registration of an EU trade mark shall confer on the proprietor exclusive rights therein.
2. Without prejudice to the rights of proprietors acquired before the filing date or the priority date of the EU trade mark, the proprietor of that EU trade mark shall be entitled to prevent all third parties not having his consent from using in the course of trade, in relation to goods or services, any sign where:
(a) the sign is identical with the EU trade mark and is used in relation to goods or services which are identical with those for which the EU trade mark is registered;
[…]
3. The following, in particular, may be prohibited under paragraph 2:
[…]
(b) offering the goods, putting them on the market, or stocking them for those purposes under the sign, or offering or supplying services thereunder;
[…].”
II. Facts in the main proceedings, proceedings before the national courts and reference for a preliminary ruling
6. Coty Germany, which sells cosmetic products in Germany, holds a licence for the EU trade mark “DAVIDOFF” for “perfumes, essential oils, cosmetics”. As a licensee, it has the power (conferred by the company holding the trade mark registration) to exercise the rights arising from that sign in its own name.
7. Amazon Services Europe S.a.r.l. (hereinafter “Amazon Services”), with its registered office in Luxembourg, provides third-party sellers the possibility of posting offerings of their products on the amazon.de website. In the event of sale, contracts concerning those goods are concluded between the third-party sellers and the purchasers.
8. Sellers are able to participate in the “Fulfilment by Amazon” scheme (8) , which entails both the stocking of products at logistics centres of Amazon group companies and the shipment of goods to the buyer and other additional services.
9. On 8 May 2014, one of Coty Germany' test purchasers ordered on the website www.amazon.de a bottle of “Davidoff Hot Water EdT 60 ml” perfume that was offered for sale by Ms OE (hereinafter the “seller”), with the indication “Versand durch Amazon” (“Fulfilled by Amazon”), as the seller had signed up for that scheme.
10. Amazon Services had instructed Amazon FC Graben GmbH (hereinafter “Amazon FC”), a company in the same group operating a warehouse of goods, based in Graben, Germany, to store the seller's products.
11. Upon learning of the sale of these products, Coty Germany ordered the seller to cease offering them, alleging that the trade mark rights over the perfume had not been exhausted. In response, the seller issued a cessation declaration, accompanied by a penalty clause in the event of non-compliance.
12. By letter of 2 June 2014, Coty requested Amazon Services to deliver all the bottles of “Davidoff Hot Water EdT 60 ml” perfume stocked on behalf of the seller. Amazon Services sent it a package containing 30 bottles of that perfume. After another company belonging to the Amazon group informed Coty that 11 out of the 30 bottles originated from a different seller’s stock, Coty Germany requested that Amazon Services disclose the name and address of that other seller, adding that the rights conferred on 29 out of the 30 bottles by the mark at issue had not been exhausted. Amazon Services informed Coty that it was not possible to specify the company owning the inventory from which the aforementioned eleven units came.
13. Coty Germany, taking the view that the conduct of Amazon Services and Amazon FC infringed upon its trade mark rights, filed legal action so that both companies would be ordered to cease stocking or dispatching bottles or perfume bearing the trade mark “Davidoff Hot Water” for putting them on the market (potentially by third parties) in the course of trade in Germany.
14. The action for an injunction concerned products not put on the market by the trade mark owner or by third parties with the consent of the former, within the national territory, as well as any other Member State of the Union or a party to the Agreement on the European Economic Area. (9) This action was accompanied by a claim for compensation of damages (the compensation sought was 1,973.90 euros, plus 5% interest from 24 October 2014).
15. Both the judgment of the court of first instance and the appellate judgment (10) rejected the claims from Coty Germany. The appellate court held, in particular, that:
– Amazon FC had not made use of the mark in question and had not possessed the bottles of perfume for the purpose of offering or putting them on the market but had simply stored them on behalf of the seller. Consequently, it should not be regarded as the perpetrator of an infringement or be ordered to cease in its actions relating to the bottles of perfume. Since it was not apparent that it was aware of the non-exhaustion of trade mark rights over the products, there were no grounds for it to be held liable as co-perpetrator or participant in an infringement of that right.
– Amazon Services had not held the goods of the seller or dispatched the products in question to its own buyers, for which reason it should, a fortiori, be exonerated.
16. With that judgment being appealed in cassation (“Review”) before the Bundesgerichtshof (Federal Court of Justice), this judicial body points out that, as Coty Germany had brought an appeal in cassation that presupposes a risk of recurrence, the appeal would only be well founded if the actions of the defendants could be considered to constitute infringement both at the time they occurred and at the time that the appeal in cassation is decided.
17. Well, the referring court requires a clarification of whether, in light of article 9(3)(b) of Regulation no. 2017/1001, a person who possesses goods which infringe trade mark rights, without having knowledge of that infringement, stocks those goods for the purpose of offering them or putting them on the market, if it is not that person himself but rather a third party alone which intends to offer or sale the goods.
18. For the referring court, this question deserves a negative answer, considering that:
– According to its own case-law on the matter of patents, the mere possession or transport of products infringing on patent rights, by a depositary, a carrier or a forwarding agent, in general, does not take place for the purpose of offering or putting them on the market. (11)
– There is no justification to undermine the limits of the holder's liability, by virtue of article 9 of the National Patent Law, through the attribution of the intent of the intermediate holder to the direct holder.
– This interpretation can be translated to trade mark law. The limits on the liability of the holder, under article 9(3)(b), of Regulation no. 2017/1001 would be widened excessively if, through the mere possession of the infringing products, this liability were transferred to a depositary unaware of the infringement.
19. In this sense, the Bundesgerichtshof (Federal Court of Justice) refers this question for a preliminary ruling by the Court of Justice, regarding the interpretation of article 9(2)(b) of Regulation no. 207/2009 and article 9(3)(b) of Regulation no. 2017/1001:
“Does a person who, on behalf of a third party, stores goods which infringe trade mark rights, without having knowledge of that infringement, stock those goods for the purpose of offering them or putting them on the market, if it is not that person himself but rather the third party alone which intends to offer the goods or put them on the market?”

Los cambios de domicilio, dirección de correo electrónico, en su caso, teléfono de contacto, firma registrada y, en general, cualquier otro dato que haya experimentado modificación respecto a los facilitados anteriormente a CatalunyaCaixa, deberán ser comunicados por el cliente a CatalunyaCaixa.
Se entenderá por lugar de cumplimiento de la obligación el del domicilio de la oficina donde está abierta la cuenta.
2.- Datos personales del cliente. Los datos personales de los firmantes se incorporarán a ficheros de CatalunyaCaixa, cuya finalidad es hacer el seguimiento de la relación contractual y el control y registro de las operaciones a su nombre. Los firmantes tienen derecho a acceder a dichos datos, a rectificarlos y cancelarlos, así como a oponerse a su tratamiento en los casos previstos legalmente. CatalunyaCaixa podrá conservarlos hasta que prescriban las acciones derivadas del presente contrato.
Asimismo, en caso de incumplimiento de las obligaciones derivadas de este contrato, CatalunyaCaixa podrá comunicar la situación de demora a los ficheros relativos al cumplimiento o incumplimiento de las obligaciones dinerarias, con los requisitos que establece la ley.
3.- Datos de terceros. En aquellos casos en que CatalunyaCaixa reciba del cliente datos de terceros para prestarle algún servicio dentro de la relación contractual que mantienen, se compromete a efectuar el tratamiento con total cumplimiento de lo que establece la Ley Orgánica 15/99 de Protección de Datos de Carácter Personal y legislación complementaria, y a no aplicarlos ni utilizarlos con finalidad diferente de aquélla para la que hayan sido facilitados.
CatalunyaCaixa se obliga a guardar secreto profesional con respecto a los datos recibidos, y a garantizar la seguridad mediante las medidas técnicas y organizativas necesarias para evitar su alteración, pérdida, tratamiento o acceso no autorizado, tanto si es por causas humanas como si provienen del medio físico o natural. Official address and communication. All communication, notifications or requirements related to these accounts that CatalunyaCaixa sends to the account holders at the addresses specified by them shall be presumed to have been received. Email addresses shall also be presumed to be valid.

Moreover, in case of noncompliance with the obligations arising from this contract, CatalunyaCaixa may report such default to the files relating to compliance or noncompliance of monetary obligations, in accordance with the requirements established by law.
3.- Third-party data. In those cases in which CatalunyaCaixa receives data about third parties from the customer in order to perform a service within the contractual relationship maintained by them, CatalunyaCaixa commits itself to use said data in compliance with the provisions of Organic Law 15/99 on the Protection of Data of a Personal Nature and supplementary legislation and shall not use them for a purpose different the one for which they were originally given.
CatalunyaCaixa agrees to maintain professional privacy as it relates to the data received and to guarantee security through the necessary technical and organisational measures in order to prevent their alteration, loss, use or unauthorised access, whether these occur through human, natural or physical causes.
The security measures to be applied to files that contain data of a personal nature shall be, at least, those specified as being of a basic and medium level in Royal Decree 1720/2007, approving the Regulations for the implementation of Organic Law 15/99 on the Protection of Data of a Personal Nature.

-Aux Etats-Unis ce n’est plus la ruée vers l’or mais la ruée vers le gaz de schiste, du gaz naturel enfermé dans la roche que les compagnies sont désormais capables d’extraire grâce à de nouvelles techniques et grâce à cela les Etats-Unis sont devenus cette année les premiers producteurs de gaz au monde, devant la Russie. Les compagnies gazières forent désormais à tout-va, au Texas, où se trouve le gisement de gaz de schiste le plus productif des Etats-Unis, le Barnett Shale, les compagnies n’hésitent pas ainsi à installer leurs derricks en pleine ville. Ce qui n’est pas sans poser de problèmes bien sûr à la population locale. Texas, la guerre du gaz, c’est un grand reportage de Murielle Paradon.
