그런데 내가 당사에 도착하기도 전에 ‘국민통합 21’의 김행 대변인이 밤 10시 반에 급히 기자들을 불러 모아 “노무현 민주당 후보와의 후보단일화를 전격 철회한다” 고 선언했다. 그녀는 다음과 같은 요지로 기자들에게 지지철회 배경을 밝혔다.
“국민 여러분에게 안타까운 말씀을 드린다. 정몽준 국민통합 21 대표는 노무현 민주당 후보에 대한 지지를 철회하며 국민 여러분이 현명한 판단을 내려주기를 기대한다. 노 후보가 오늘 저녁 명동 합동 유세에서 ‘미국과 북한이 싸우면 우리가 말린다’ 고 했는데 이런 표현은 매우 부적절하며 정당 간 정책공조 정신에 어긋나는 발언이라고 우리는 판단했다. 미국은 우리를 도와주는 우방이지, 미국이 북한과 싸울 이유는 없다는 것이 우리 생각이다. 단일화 정신의 원칙은 청책공조와 상호 존중인데 합동유세에서 이런 발언은 단일화의 원칙이 지켜지지 않은 사실을 확인시켜줬다.”
단일화가 깨진 것이다.
당사에 선대위 간부들이 속속 모여들었다. 내가 당사에 도착해 후보실로 가보니 노 후보녀는 젊은 당원들에게 둘러싸여 있었다. 젊은이들 가운데 내가 알아본 사람은 임종석 한 명뿐이었지만 짐작컨대 안희정, 이광재 등 노 푸보 심복들이 전원 집합해 있는 것이 분명했다. 나는 급히 젊은이들에 둘러싸여 있는 노 후보를 향해 말했다.
“후보님, 지금 빨리 정 대표에세 전화하셔서 사과하시고 이 사태를 바로잡아야 하겠습니다.”
그러지 갑자기 방 안 분위기가 싸하게 바뀌더니 한 젊은이가 내게 버럭 소리를 질렀다.
“아니 허 의원은 왜 우리 후보한테 사과하라고 하는 겁니까?”
한마디로 어의가 없었다. 비상 상황을 타개하기 위해 긴급 건의를 하는 내게 마치 반역자라도 된다는 듯이 몰아붙이고 나오는 젊은이 들의 적대적 반응에 정신이 아득해져 그만 그 방에서 나오고 말았다.
옆방으로 건너와 숨을 고르는데 정대철, 김원기 의원 등이 잇따라 도착했다. 나는 당 원로들에게 방금 전 있었던 일을 보고했다. 사과하라고 했는데 젊은이들이 벌떼처럼 들고일어나 왜 사과하느냐고 했다는 내 말을 듣고는 이해찬 의원이 담배를 피워 물고 방안을 왔다 갔다 하면서 느릴 곡조로 이같이 혼자 읊조리는 것이었다.
“피이양 가암사도 지하기 싫으면 안 하는 것이지이이~~”
나는 김원기, 정대철 두 분에게 빨리 뭔가 조처를 취하라고 채근했다. 그러자 두 분이 움직이기 시작했고 이어 노 후보가 당 중진들이 있는 옆방으로 건너왔다. 그래서 나는 노 후보에게 재차 사과하라고 재촉했다. 내 목소리에 약간 노기가 들어 있었던 것으로 기억된다.
나는 노 푸보가 내 건의를 받아들이려니 했다. 그런데 그게 아니었다. 노 후보는 눈을 부릅뜨고 나를 쳐다보면서 언성을 높여 이렇게 말했다.
“아니 내가 왜 그런 사람한테 사과까지 하면서 대통령을 해야 합니까? 그럴 바에는 나, 대통령 안 할 거에요!”
그래서 나도 맞고함을 질렀다.
“아니, 노 푸보님 개인을 위해서 대통령 하시라는 겁니까? 국민을, 나라를 위해서 대통령 하시라는 것이고 그것 때문에 우리가 여기까지 왔는데 지금에 와서 대통령 안 하겠다고 나오시면 그게 말이 됩니까?”
선거전에 뛰어들어 내가 처음으로 목소리를 높인 것이 이때였다.
그러자 노 후보가 “처음부터 (정 대표가) 그런 사람인 줄 알았다. 내가 그런 사람하고 손잡고 대통령이 되어 봐야 뭐 하겠나. 대통령 안 하면 그만이다” 식으로 푸념을 섞어 중얼거렸다.
안되겠다 싶었던지 김원기, 정대철, 이해찬 의원이 노 후보를 열심히 설득하기 시작했고 마침내 노 후보도 고집을 꺾고 정 대표를 만자보기로 했다. 밤 11시쯤 한화갑 대표 일행이 국민통합21 당사로 급히 달려갔다.
조금 있으니 신문 호외가 배달되기 시작했다. 신문들은 하나같이 대문짝만 한 활자로 ‘정몽준, 노무현 버렸다’라고 보도하고 있었다.
노무현 후보도 움직였다. 노 푸보는 새벽에 평창동 정뭉준 대표 자택으로 달려갔다. 하지만 노 푸보는 대문 밖에서 발길을 돌려야 했다. 박범진 전 의원 등 국민통합 21 관계자들도 정몽준 설득에 나섰지만 역시 정 대표를 만나지 못했다.
대선 투표 당일인 19일 새벽 5시 반, 노무현 후보가 긴급 기자회견을 열었다. “뜻하지 아니한 일로 국민 여러분들께 혼란을 드려서 대단히 송구스럽습니다. 솔직히 말씀드려서 저는 사태가 이와 같이 된 데 대해서 영문을 잘 모르고 있습니다.”
노 후보가 이러는 사이 정몽준 대표는 “투표도 하지 않겠다, 대선 이후에 입장을 밝히겠다”고 대변인을 통해 발표하고는 자택에서 칩거를 계속했다.
Translation - English [Bad Luck Strikes the Night Before Election]
Before I had even arrived at the headquarter, the National Alliance 21 Party’s spokesperson had already gathered the reporters and made a statement that Jung was “withdrawing himself from the single candidacy with the Democrat’s candidate Roh.” She explained, “We are sorry to deliver this news to the public. As candidate Jung withdraws his support for candidate Roh, we hope our citizens will make a wise decision. During this evening’s joint campaign in Myeongdong, Roh made a statement that if the U.S. and North Korea were to go to war, our country would step in to try to help stop it. Our party feels that such a statement is inappropriate and goes against the spirit of policy coordination between our two parties. We believe the U.S. is our ally, and there’s no reason for them to go to war with the North. The single candidacy is based on the principle of mutual policy-making and respect, but Roh’s statement today showed he doesn’t abide by these principles.”
The united front had been compromised. Soon after the statement was given, committee heads began arriving at the headquarter. By the time I had arrived, Roh was surrounded by young party members. The only person I recognized in the group was Jong Suk Lim, but I figured Hee Jung Ahn, Gwang Jae Lee and Roh’s other right hand guys were also there. I spoke to Roh through the crowd. “Candidate Roh, I think you should call candidate Jung right now, apologize, and fix the situation.” Suddenly, the room became quite frosty, and suddenly, a young man looked at me and shouted, “Assemblywoman Huh, why do you think we need to apologize?”
I was speechless. I couldn’t believe the they were treating me like some kind of a traitor when, in fact, I had summoned the meeting to try to get us out of this emergency. Taken back by their hostile reaction, I left the room and went into the next one. I was calming myself in the other room and a few minutes later, assemblymen Dae Chul Jung and Won Gi Kim came in. I told these senior party members about what had just happened in the other room, and how the younger members rose up like a swarm of angry bees when I told Roh to apologize. After hearing me, Hae Chan Lee, smoking his cigarette and pacing back and forth said uttered in a slow tempered voice, “It doesn’t matter how high the position is, if you don’t want it, then you do~~~~~n’t want it.”
As I urged Kim and Jung to take an immediate action about the situation, the two men started to get moving, and at that moment, Roh came into our room. I urged him once again to apologize to Jung. Looking back, I vaguely remember how my voice conveyed my upset feelings at the time. I was somewhat expecting Roh to heed my advice. But I was wrong. Glaring, he looked at me dead in the eye and asked me in an elevated voice, “Why should I have to apologize to someone like him to become the president? If that’s what it will take, I don’t want to be the president!” I yelled back at him, “Are you trying to become the president for yourself? We want you to become the president for our country and our people. We have come this far, and it doesn’t make sense for you to say now that you don’t want t to be the president!” This was the first time I’d raised my voice since joining the campaign. Roh muttered moaningly, “I already knew Jung’s true colors. What would be the point of becoming the president if I had to work with someone like that? If that’s the case, I’d rather just not be the president.” Seeing the seriousness of the situation, the other assembly members started trying to change Roh’s mind, and finally he agreed to meet with Jung. Around eleven o’clock at night, Wha Gap Han and some others hastily made their way to the National Alliance 21’s headquarter.
A few hours later, the morning newspapers were starting to be delivered, and every single one of them had “Jung Abandons Roh” reported on their front page in a giant font. Roh got moving too and rushed to Jung’s house in the middle of the night. However, it was to no avail. Despite the members of Jung’s party and team who were also trying to get him to reconcile with Roh, Jung refused to come out and see Roh.
On the morning of the election day at five am, Roh called for an emergency press conference. “I am very sorry to have perturbed all of you with an unintended situation like this. To be honest, I don’t really know why all this happened.” Meanwhile, Jung made the statement that he “won’t be voting and (that he) will make an official statement after the election” and continued to hide out at his house.

제 3장 국제 산업재산권 분쟁발생에 따른 국내기업의 대응방안
앞서 조사된 통계자료들을 기반으로 국내기업의 산업재산권 분쟁에 대한 전반적인 실태를 파악해 보았다. 현재 발생하고 있는 산업재산권 분쟁은 국내기업이 피소당하거나 국내기업이 제소하여 발생할 경우로 나누어 볼 수 있다. 또한 이러한 분쟁은 분쟁이 발생하지는 않았지만 발생확률이 높은 ‘분쟁 사전 단계’ 와 이미 분쟁이 시작된 ‘분쟁 사후 단계’ 로 구분할 수 있을것이다.
위와 같이 구분 된 산업재산권 분쟁 발생 유형을 대표적인 사례 중심으로 살펴보고(42) 각 단계에서 필요한 대응방안에 대해 살펴보도록 하겠다.
제 1절 초기 분쟁 대응방안
본 논문에서는 분쟁 발생 확률이 높은 즉, 분쟁이 발생하진 않았지만 예고되어 있는 상황의 단계를 ‘분쟁 사전 단계’라고 구분하였다. 분쟁 사전 단계에 해당하는 상황으로는 납품처나 바이어로부터 해당 제품에 대한 ‘특허 보증’을 요구 받은 상황이거나, ‘국내외 전시회 참가 전’ 상황의 경우로 구분해 볼 수 있다.

특허 보증 요구 대응
납품처나 바이어로부터 ‘특허 보증’ 을 요구받은 상황을 살펴보면 완성품 제조기업이 아닌 부품 제조기업이 납품처로 부터 해당 제품의 특허문제가 없음을 보증하거나, 향후 특허 문제 발생 시 책임을 묻도록 하는 ‘특허보증계약’을 요구받는 사례가 늘어나고 있다. 최근 특허권자들은 완성품 업체를 타켓으로 특허분쟁을 제기하는 추세이며 이에 따라 부품이 특허침해라고 하더라도 완성품 업체가 특허분쟁에 휘말리게 되어 손해배상 뿐 아니라 영업상 타격을 받게 되어 있다. 분쟁으로 인한 피해를 줄이기 위하여 완성품 기업들은 자사가 구매하는 부품에 대한 특허보증을 요구하고 있는 것이며 구매하는 부품에 특허침해가 발생하지 않는다는 확신이 있기 전에는 특허침해 분쟁이 예상되는 부품을 채용할 수 없는 것이다. 43) 이러한 상황에서 특허보증계약을 요구받게 된 부품업체들이 해당 제품에 대한 특허분석 및 보증계약서에 대한 철저한 검토 없이 특허보증을 체결하게 되면 향후 관련 분쟁 발생 시 막대한 손해를 입게 된다.

Chapter 3 Response measures for domestic companies industrial property disputes
Based on the previously gathered statistical data, I have summarized the overall present conditions under which our domestic companies are involved in industrial property rights disputes. Current industrial property rights disputes fall into two categories. The first one is a case where our domestic company is being sued, and the second is where our domestic company is filing the lawsuit. We can also further categorize the disputes into “pre-dispute phase” in which there is yet a dispute but the probability of one is high and “post-dispute phase” where the dispute has already started.
This essay will take a closer look at these different categories of industrial rights disputes as defined above by focusing on a representative example of each category (42). It will also look at the possible response measures for these categories.
Clause 1 Response measures for an early stage dispute
This essay defines situations in which there is no present dispute but a dispute is forewarned as belonging to the “Pre-dispute phase”. Included in this phase are circumstances where the vendor or the buyer has made a request for ‘patent assurance’ pertaining to a relevant product or situations in which a company is about to participate in either a domestic or an international exhibition.
42) This example has been taken from the aforementioned Book 1, and this booklet derives from examples the writer has applied for and participated in.
1. Responding to a ‘patent assurance’ request
Looking at situations in which the vendor or the supplier has requested a “patent assurance”, we can see there are increasing number of cases where a vendor requests a component manufacturer, not a manufacturer of a finished product, for a guarantee that the relevant product doesn’t come with any patent problems, or requests a ‘patent assurance contract’ to ensure manufacturer accountability in case a patent problem arises in in the future. Recent trends are seeing patent holders filing lawsuits against manufacturers of finished products and as such, these manufacturers can get entangled in a patent dispute even when it’s their product’s component that violates a patent right. Such lawsuits force manufacturers to pay damages and hurt their sales. Thus, finished product manufacturers are demanding a “letter of assurance for patents” for components they are buying to avoid any losses from possible disputes, and they cannot purchase any components without an assurance that there won’t be any patent violation. (43) Under such circumstances, if component manufacturers that have received a request for a letter of assurance for patent sign the letter without conducting a thorough analysis of the relevant product’s patent and an examination of the assurance contract, they will incur immense damages should a dispute occur at a later time.

I was born in Korea and grew up there as a little girl until my father took a job as an exchanged professor at University of Minnesota and our family decided to relocate.
